Mark Duggan's mother allowed to challenge inquest verdict

 

LONDON 

The mother of Mark Duggan has been given the right to challenge the verdict of the inquest into his death, which found he was lawfully killed by the police.

Justice Mitting has granted limited permission to apply for this review as the coroner’s direction to the jury about the conclusion of lawful killing was inadequate in two respects: There was a failure to make it clear to the jury that “they must conclude, on the balance of probabilities, that, V53 (police officer) did honestly, even if mistakenly, believe that Mark Duggan held a gun in his hand immediately before he was shot” and “if V53 had the honest belief, even if it was mistaken, that the mistake must have been a reasonable one for him to have made.” Therefore Justice Mitting concluded that it was "arguable that the conclusion of lawful killing cannot stand."

Mark Duggan was shot dead in Tottenham, north London, by police as they attempted to arrest him as part of an operation against a gang called the Tottenham Man Dem. 

His death sparked riots across London.
